MCC: Big Changes for NEET UG and PG Counseling for NRI Students

📢 Important Update: Medical Counselling Committee (MCC) has released an official notice regarding strict eligibility criteria and document verification for candidates claiming NRI/OCI status or converting nationality from Indian to NRI for NEET UG & PG Counselling.

The Medical Counselling Committee (MCC), Directorate General of Health Services (DGHS), has issued a critical notice for all medical aspirants planning to apply under the NRI Quota for the upcoming academic session. If you are a NEET UG or NEET PG candidate seeking admission through NRI quota seats or looking to convert your nationality status from Indian to NRI, this update is extremely vital for you.

The new guidelines strictly enforce the landmark judgment passed by the Hon’ble Supreme Court of India in W.P No. 13393 of 2007 (Anshul Tomar vs. State of M.P). The competent authority will now scrutinize sponsor relationships and require strict legal evidence during the counselling process.

Key Eligibility Criteria for NRI Quota Seats

According to the Supreme Court order re-emphasized by MCC, candidates must meet specific first-degree or legal guardianship relationships with their NRI sponsors to be eligible for seat allotment. Below are the conditions defined by the committee:

1. Direct Parents (Father / Mother)

If the student's real father or real mother is an NRI and ordinarily resides abroad, the candidate is directly eligible under the NRI quota.

2. First-Degree Relatives

If a first-degree relation of the student is an NRI and resides abroad ordinarily, the student qualifies. First-degree relations primarily include real brothers and sisters of the candidate over and above father and mother.

3. Blood Relations under Nearest Relatives

If the candidate is sponsored by a relative other than direct parents or siblings, the sponsor must fall within the strictly defined list of blood relations:

• Paternal Relatives: Real uncle and real aunt (real brother and sister of father).
• Maternal Relatives: Real maternal uncle and real maternal aunt (real brother and sister of mother).
• Grandparents: Grandfather and grandmother (both paternal and maternal).
• Cousins: First-degree paternal and maternal cousins.

Strict Document Verification & Legal Guardianship Rules

The biggest change this year lies in the verification process. MCC has made it clear that simply claiming a relative is an NRI sponsor will not be sufficient. Aspirants must present verifiable legal evidence during counselling.

⚠️ Crucial Requirement for Guardianship:
As per point 3(d) & (e) of the Supreme Court judgment, if an eligible relative is sponsoring the candidate as a guardian (Palya), the candidate must present:

1. Evidential Proof of Guardianship: Legal documents demonstrating that the sponsor is the Bonafide Legal Guardian of the student under the Guardians and Wards Act, 1890.
2. Legal Affidavit: A duly executed sworn affidavit confirming that the sponsor has actually looked after the student as a guardian while residing abroad.

• Ensure your NRI sponsor's documents (Passport, Visa, Embassy Certificate, Tax Documents) are up-to-date and valid.
• If sponsored by a legal guardian, obtain the valid guardianship decree/court order under the Guardians and Wards Act, 1890 well before counselling starts.
• Keep the legal affidavit in the prescribed format ready prior to the document submission window announced by MCC.
• Failure to produce legitimate legal proof will lead to immediate cancellation of NRI status, and the candidate will be treated as a General/Indian candidate.
